You have been served with a foreclosure complaint that could cause you to lose your home. The New Jersey Judiciary has set up a Foreclosure Mediation Program to assist certain homeowners. This program is available to all qualifying homeowners whether or not they file an answer to the foreclosure complaint.

Foreclosure mediation is a process where a neutral mediator assists lenders and borrowers in trying to reach a voluntary and mutual agreement to resolve a loan delinquency. Foreclosure mediation will take place in county courthouses with trained mediators.

You can take advantage of the the free mediation program if:

  1. You are an owner-occupant of a one- to three- family residential property.
  2. The property is your primary residence.
  3. You are the borrower and your mortgage loan is being foreclosed.
  4. You are not in bankruptcy, or, if you filed for bankruptcy, the petition is discharged, dismissed or the bankruptcy stay has been lifted to allow the foreclosure to proceed.

 You Can Participate in Free Foreclosure Prevention Housing Counseling if:

  1. You have wages or income to fulfill a possible mortgage loan workout.
  2. The property is your primary residence, which is a one- to three-unit property.
  3. You are the borrower and your mortgage loan is being foreclosed.
  4. You own no other real property.
  5. You are not in bankruptcy, or, if you filed for bankruptcy, the petition is discharged, dismissed or the bankruptcy stay has been lifted to allow the foreclosure to proceed.

Call the toll-free telephone number 1-888-989-5277 at the top of this notice and ask for the name of a housing counselor in your area certified by the Department of Housing & Urban Development (HUD) and the New Jersey Housing and Mortgage Finance Agency (NJHMFA).

 CAUTION: Applying for foreclosure mediation will not stop your lender from moving forward with its foreclosure action.
